Yeah, based on the 9 months suspension and the possible sanctions under 105, must've been option 'C', 'assualt.' Actual or ability to injure...
What a mess that must've been - the reports were vague which was probably all too kind to Fon.

I had a front row seat for the final straw that got Fonseca suspended. It was many orders of magnitude beyond what Chris described at districts. Many.
Keep in mind that sometimes people will use verbal intimidation to get people to do what they want in a race. Not: "Pull through or I'll punch you." More like "Pull through you wuss". You might be suprised how often somebody will do something that isn't really in their best interest if they are told forcefully enough.

Good stuff.... Even being in racing for > 5 years I did not know that rule existed. From the beginning, in my experience, this behavior has been at every race.
Not a readily advertised rule I guess...
Obviously, the physical abuse is a no-brainer

Check out page 35-36:
1O5. Abuse. (a) No rider or licensee may be disrespectful toward organizers, officials, riders or spectators [warning for minor offense; possible relegation of rider; and/or up to a $50 fine]. (b) No rider or licensee may use foul or abusive language or conduct during a race event [disqualification and 15 days suspension].
(c) No licensee may assault (an unlawful attempt, coupled with the present ability, to commit a violent injury on the person of another) or do battery (any willful and unlawful use of force or violence upon the person of another) to anyone connected with any event (including but not limited to riders, officials, spectators, public officials, etc...) held under a USA Cycling permit. [disqualified from the event, prohibited from participating in another event for 72 hours & suspended for up to one (1) year after due process]

Maybe the other 'jerks' will take note of this suspension & state their cases more politely. Wishful thinking, I know, but this has brought the rule back into our awareness. 9 months is also a school year, maybe Fon had to go back to kindergarten to learn to play nicely with others...

Let the comments go and realize that most of them come from individuals that are unhappy with their own performance.

As a rookie, I have been the target of a lot of hollering in the peloton, but for the most part it doesn't bother me.
Some of it is deserved, but a lot of guys are just jerks.
Just this weekend at the District RR, some jerk yelled at me about 80 miles into the race "Why don't you take a pull you f****** woman!"
I had been taking plenty of pulls all day long, and was about to bonk (which I did a few miles later), but that's beside the point. I've been in plenty of groups where there were guys who were not pulling, and I've never felt the need to verbally abuse them.

My god I just can't decide on this one...help me out people, which is it?
a) 9 months = one day for every time he hollered at someone
b) 9 months is the first-offense penalty for roid rage where the "film canister defense" is not invoked
c) USAC picked first number to pop up on PowerBall on day of hearing
d) as with all cycling penalties - they didn't want to inconvenience the rider
e) April 6, 2007, his "back racing again" date, is the Christian holiday of Holy Saturday, a day of Resurrection (true story!)
f) Fonseca convinced USAC he's JC. See f).
Drum roll please....
g) 9 months is how long it takes to create a cute, cuddly, and lovable human being from a rude, nasty, sweaty, table-thumping, screaming-loud, ___(censored!)___. :shock:
